SUPREME COURT OF OHIO COLUMBUS ANNOUNCEMENT FRIDAY August 23, 1996 MOTION DOCKET 96-1695. State ex rel. Olander v. French. Franklin County, No. 96APD04-501. This cause is pending before the court as an appeal from the Court of Appeals for Franklin County. Upon consideration of the motion of appellants/cross-appellees for expedited oral argument, IT IS ORDERED by the court, sua sponte, that the briefing schedule provided for a case involving a cross-appeal in S.Ct.Prac.R. VI(4) shall be modified in this case as set forth below: (1) First brief shall be due August 30, 1996. (2) Second brief shall be due September 16, 1996. (3) Third brief shall be due October 1, 1996. (4) Fourth brief shall be due October 8, 1996. IT IS FURTHER ORDERED by the court, sua sponte, that the provisions for extension of time in S.Ct.Prac.R. XIV(3)(B)(2) shall not apply to the filing of the above briefs. MISCELLANEOUS DISMISSALS 96-1363. Presrite Corp. v. Commercial Union Ins. Co. Cuyahoga County, No. 68704. This cause is pending before the court as a discretionary appeal and as a claimed appeal of right. Upon consideration of appellants' application for dismissal, IT IS ORDERED by the court that the application for dismissal be, and hereby is, granted. ACCORDINGLY, IT IS FURTHER ORDERED by the court that this cause be, and hereby is, dismissed. 96-1532. State ex rel. Wilson v. Indus. Comm. Franklin County, No. 95APD08-968. This cause is pending before the court as an appeal from the Court of Appeals for Franklin County. It appears from the records of this court that appellant has not filed a merit brief, due August 20, 1996, in compliance with the Rules of Practice of the Supreme Court and therefore has failed to prosecute this cause with the requisite diligence.
