SUPREME COURT OF OHIO COLUMBUS ANNOUNCEMENT THURSDAY January 28, 1999 DISCIPLINARY DOCKET 98-1302. Disciplinary Counsel v. Sweeney. Upon consideration of respondent's motion for leave to file additional factual information, IT IS ORDERED by the court that the motion for leave to file additional factual information be, and hereby is, denied. Pfeifer, Cook and Lundberg Stratton, JJ., dissent. MISCELLANEOUS DISMISSALS 98-2362. State ex rel. Viceroy v. Fuerst. Cuyahoga App. No. 75078. This cause is pending before the court as an appeal from the Court of Appeals for Cuyahoga County. It appears from the records of this court that appellant has not filed a merit brief, due January 19, 1999, in compliance with the Rules of Practice of the Supreme Court and therefore has failed to prosecute this cause with the requisite diligence. Upon consideration thereof, IT IS ORDERED by the court that this cause be, and hereby is, dismissed sua sponte. 98-2461. State ex rel. McCuller v. Callahan. Cuyahoga App. No. 71961. This cause is pending before the court as an appeal from the Court of Appeals for Cuyahoga County.
