Gonsor. Cuyahoga App. No. 80944, 2003-Ohio-2297. This cause is pending before the court on the certification of a conflict by the Court of Appeals for Cuyahoga County. On March 11, 2004, amicus curiae Ohio Academy of Trial Lawyers filed a motion for leave to file a responsive brief to amicus curiae Member Companies of the American International Group, Inc.'s reply brief. Whereas, the Rules of Practice do not permit the filing of a response to a reply brief, IT IS ORDERED by the court, sua sponte, that amicus curiae Ohio Academy of Trial Lawyers' motion for leave be, and hereby is, stricken. 2003-1092. State ex rel. Regal Ware, Inc. v. Indus. Comm. Franklin App. No. 02AP-1264, 2003-Ohio-4184. This cause is pending before the court as an appeal from the Court of Appeals for Franklin County. Upon consideration of appellant's motion for extension of time to file merit brief pursuant to S.Ct.Prac.R. XIV(6)(C), IT IS ORDERED by the court that the motion for extension of time be, and hereby is, granted, and appellant's merit brief is due on or before March 31, 2004. MISCELLANEOUS ORDERS In re Report of the Commission : on Continuing Legal Education. : E N T R Y Mark Mariotti : (#0067608), : Respondent. : This matter originated in this court on the filing of a report by the Commission on Continuing Legal Education ("commission") pursuant to Gov.Bar R. X(6)(A)(1)(b) and (A)(2)(d). The commission recommended the imposition of sanctions against certain attorneys, including the above- named respondent, for failure to comply with the provisions of Gov.Bar R. X, Attorney Continuing Legal Education, for the 2001-2002 reporting period. On December 5, 2003, this court adopted the recommendation of the commission, imposed a sanction fee upon the respondent, and suspended the respondent from the practice of law pursuant to Gov.Bar R. X(6)(B)(3) and (5)(A)(4). The court further ordered that respondent shall not be reinstated to the practice of law in Ohio until respondent complies with the requirements for reinstatement set forth in Gov.Bar R. X(7), respondent complies with the Supreme Court Rules for the Government of the Bar of Ohio, respondent complies with this and all other orders of the court, and this court orders respondent reinstated. On March 11, 2004, the commission filed a recommendation pursuant to Gov.Bar R. X(7)(B)(2), finding that the respondent has paid all fees assessed for noncompliance, has made up all deficiencies and is now in full compliance with all requirements of Gov.Bar R. X, and recommending that the respondent be reinstated to the practice of law in Ohio. On March 11, 2004, the commission certified that respondent had completed the credit hours of continuing legal education required during his suspension by this court's order of suspension. Upon consideration thereof, IT IS ORDERED by the court that the recommendation of the commission be adopted and that respondent, Mark Mariotti, be reinstated to the practice of law. MEDIATION REFERRALS The following cases have been referred to mediation pursuant to S.Ct.Prac.R. XIV(6): 2004-0290. State ex rel. Dayton Foods L.P. v. Unger. Franklin App. No. 02AP-1076, 2003-Ohio-7228. ADMINISTRATIVE ACTIONS 1. Amendments to the Standard Probate Forms and Sup.R. 64 and 99 (Accounts) were adopted. 2. Amendments to the Supreme Court Rules of Practice were adopted, effective July 1, 2004. 3. Facsimile Filing Standards and Model Rule pursuant to Sup.R. 27 were adopted. 4. Jana E. Gutman was appointed to the Board of Commissioners on Grievances and Discipline. 5. Frank R. DeSantis was appointed to the Board of Commissioners on the Unauthorized Practice of Law. 6. Judge Patricia A. Blackmon was appointed to the Board of Commissioners of the Clients' Security Fund of Ohio. 7. Diana Lipszyc was appointed to the Committee for Lawyer Referral and Information Services. ---------- |
