King, the Honorable Myriam Lehr, and Supervisor of Elections David C. Leahy, in their official capacities as members of the Board, assert that pursuant to state statute they are a neutral ministerial body charged with tabulating the votes in the November 7, 2000 Presidential election. See Morse v. Dade County Canvassing Board, 456 So. 2d 1314 (Fla. 3d DCA 1984). Accordingly, the Miami-Dade Canvassing Board respectfully requests that the Court affirm that portion of the lower court's order which states that it acted properly and did not abuse its discretion.
