Beckstrom v. Volusia County Canvassing Board,
707 So. 2d 720 (1998)
-iv-

ARGUMENT
Appellees, Nassau County Canvassing Board, and the Honorable Robert E.
Williams, Supervisor of Elections, Shirley N. King, individually and as Supervisor of
Elections, Commissioner Marianne Marshall, and Commissioner David Howard, in
their official capacities as members of the Nassau County Canvassing Board, assert
that, pursuant to State Statute, they are a body charged with certain matters pertaining
to the November 7, 2000, Presidential election. The Nassau County Canvassing Board
and the Supervisor of Elections acted within substantial compliance of the Statutory
provisions. See Beckstrom v. Volusia County Canvassing Board, 707 So. 2d 720
(1998).
Accordingly the Nassau County Canvassing Board respectfully requests that the
Court affirm that portion of the lower Court's Order which states that it acted properly
and did not abuse its discretion. With regard to the remaining issues on Appeal, the
Appellees take no position.
