Summaries of Selected Cases -- April 19, 2002

For more information, contact: Ron Keefover, Office of Judicial Administration, Kansas Judicial Center, 301 West 10th, Topeka, KS 66612-1507 (785-296-2256), e-mail: keefover@kscourts.org.

The Supreme Court today filed 29 opinions. The full text of these decisions may be found at www.kscourts.org. Today's filings include:

Appeal No. 87,009: State v. Alrick Eugene Payne Sr.

The court, in a unanimous decision authored by Justice Bob Abbott, affirms the defendant's Leavenworth County convictions of felony murder, aggravated robbery, possession of cocaine, and possession of drug paraphernalia, which arose from the March 2, 2000, discovery of the body of Eddie Harris, 65.

Appeal No. 86,042: State v. Calvin E. Hullum Jr.

The court, in a unanimous decision authored by Justice Edward Larson, affirms the defendant's Wyandotte County convictions of first-degree felony murder and 25 related offenses arising from a string of crimes committed by Hullum between September 1998 and May 1999.

Appeal No. 86,258: State v. Marcus D. Clemons

The court, in a unanimous decision authored by Justice Donald Allegrucci, affirms the defendant's Sedgwick County convictions of first-degree murder, attempted first-degree murder, and criminal possession of a firearm for which he received a controlling sentence of 732 months imprisonment (rejecting challenges of sufficiency of the evidence of premeditation, effectiveness of his waiver of a jury trial, refusal to continue the trial, failure to make a record of closing arguments, and the imposition of the 732-month sentence).

Appeal No. 87,620: State v. Milda J. Sandstrom

Saying the trial court held in favor of the public interest, the court in a unanimous decision authored by Chief Justice Kay McFarland, affirms the denial of the defendant's motion to erase her first-degree murder conviction, which arose from the 1977 slaying of broadcast executive Thad M. Sandstrom.

Appeal No. 86,605: State v. Kenyon T. Campbell

The court, in a unanimous decision authored by Justice Tyler C. Lockett, affirms the defendant's Sedgwick County sentences and convictions for first-degree murder and a series of related crimes arising from March 22, 1966, kidnaping of a man at a private club and the murder of a second man at another.

Appeal No. 86,098: State v. Steven Bloom

The court, in a unanimous decision authored by Justice Tyler C. Lockett, affirms the defendant's Shawnee County second-degree intentional murder conviction and sentence of life imprisonment, rejecting seven contentions of trial error, which arose from the October 1998 shooting death of Deanna Porter, who died from a gunshot wound in Bloom's residence.

Appeal No. 86,161: State v. Demetrius Hargrove

The court, in a unanimous decision authored by Justice Edward Larson, reinstates capital murder charges against the defendant in a Wyandotte County case arising from the February 1998 shooting deaths of Elmer Berg and Berg's sister, Misty Castor. (The trial court had dismissed the charges on grounds that Hargrove's speedy trial rights under the Agreement on Detainers Act had been violated.)

Appeal No. 86,325: Levoi D. Easterwood v. State of Kansas

The court, in a unanimous decision authored by Justice Edward Larson, affirms a Wyandotte County decision refusing to set aside the defendant's guilty plea to felony murder and related charges, holding that he is not entitled to collaterally attack his convictions to benefit from a favorable ruling in a later appeal by a different party on the same legal issue he waived when he entered the guilty plea. (The charges arose from the November 1995 shooting of a robbery accomplice by police who had been summoned to a robbery at a Kansas City drug store.)

Docket No. 87,967: In Re: Matthew B. Works

The court places a Topeka attorney on 18 months supervision of his law license based on four violations of the Kansas Rules of Professional Conduct emanating from his representation in two unrelated proceedings.
